Subject:- Fixation of Pay in case of employees transferred to a lower post on their own request under rule 227 (a) (2) of IREC VoL.I (FR-15(a)) aud subsequently promoted to higher post in the new unit-clarification regarding.
Instructions regarding fixation of pay in case of employees transferred to a lower post on their own request under Rule 227 (a) (2) of!REC Voi.I (FR-15(a)) )1ave already been circulated on Railways from time to time. In this regard, doubts have been raised by various Railways as to the method of fixation of pay of such employees when they subsequently become eligible for promotion to the next higher grade or same higher grade from which they have been transferred to the lower post, in the transferred department i.e. in the new unit.
2. Since Ministry of Railway follows instructions circulated by Department of Personnel & Training, Ministry of Personnel, Public Grievances & Pensions in this regard, the matter was referred to them for
seeking their clarification on the matter. They have now given clarification in the two different situations
as follows:

Change in the Name of Passenger Holding Confirmed Reservation
1. Save as otherwise, a berth or a seat reserved in the name of a person shall be used only by the person and shall not be transferable to any other person.
2. Chief Reservation Supervisor of important stations are authorized by Railway Administration to permit the change of name of a passenger having a seat or berth reserved in his name in the following circumstances namely :
(a) Where the passenger is a Government Servant, proceeding on duty and appropriate authority, makes a request in writing 24 hours before the scheduled departure of trains
(b) Where the passenger makes a request in writing 24 hours before the scheduled departure of the train that the reservation made in his name may be transferred to another member of his family, meaning, Father, Mother, Brother, Sister, Son, Daughter, Husband and Wife.
(c) Where the passengers are students of a recognized educational institution and the Head of the institution makes a request in writing 48 hours before the scheduled departure of the train, that the reservation made in the name of any student be transferred to any other student of the same institute.
(d) Where the passengers are members of a marriage party and any person deemed to be Head of such party makes a request in writing 48 hours before the scheduled departure of the train that the reservation made in the name of any member of the marriage party be transferred to any other person.
(e) Where the passengers are a group of cadets of National Cadet Corps and any officer who is the head of the group, makes a request in writing at least 24 hours before the departure of the train that the reservation made in the name of any cadet be transferred to any other cadet.
Such request will be granted only once. Regarding item no. (c), (d) and (e), such request for change in excess of 10% of the total strength of group shall not be granted.

Here's how an employee can keep track of his EPS amount
An individual switches jobs and usually transfers the Employees' Provident Fund (EPF) balance to the new employer. But what happens to the funds in the Employees' Pension Scheme (EPS) continues to remain a mystery for many. While the PF account number of the new employer shows the transferred EPF balance, what about the EPS money from the previous employer?
Here are a few pointers on how the EPS works and how one can avail it:
An employee contributes 12 per cent of his basic salary directly towards EPF.
*He does not contribute directly towards EPS.
*Of the employer's share of 12 per cent, 8.33 per cent is diverted towards the EPS, with a cap of Rs 1,250 (earlier Rs 541) a month.
*When the employee switches jobs, the EPF gets transferred to the new employer, but not the EPS.
*When the employee switches jobs, the EPS contributions stay with the EPFO.
**The employee has the option to either withdraw the EPS amount or carry it forward to the next job. This, however, depends on the length of his service and his age.
Less than 10 years in job
If an employee has not completed 10 years in service, he can either withdraw the EPS amount, or take the 'scheme certificate'. If he is still working, but hasn't completed 10 years, this, however, is not possible. He can apply only after he has quit his job, i.e., before joining another company.
The option to withdraw or take the scheme certificate has to be submitted by filling Form 10C, which can downloaded here . Recently, the EPFO introduced 'UAN based Form 10C', which can be downloaded here .
This form can only be used by an individual who has furnished employee details to the existing employer in 'Form 11-New' ( download here ), furnishing the Aadhaar, bank details, and after getting the Universal Account Number (UAN) activated by providing a cancelled cheque with name, account number and IFS Code. Currently, UAN based Form 10C can only be used for withdrawal and not for taking the scheme certificate.
If you have worked for less than six months, the EPS contributions cannot be withdrawn as the EPFO rules say that for those who have not yet completed 180 days in the organisation, the withdrawal benefit is not admissible. One can, however, apply for the scheme certificate.
The employee won't get the entire contribution (Rs 541/Rs 1,250 a month) back after applying through Form 10C. The amount received will be subject to Table D as below.

Madam /
Sir,
At the
outset, I would like to convey my best wishes for the new academic session
2016-17 and at the same time wish to draw your attention towards an important
issue i.e. Transfer Guidelines. Transfer Guidelines of Kendriya Vidyalaya
Sangathan effective from 1.4.2011 were in operation with some amendments made
from time to time.
With the
passage of time, we felt a need to review it. In order to make transfer
guidelines more transparent, employee friendly and Information Technology
enabled, KVS had invited suggestions and feedback last year from all Teaching
and Non-Teaching Employees, Principals, Deputy Commissioners, other officers at
Regional Offices, ZIETs and all Service Associations of KVS.
1.As a
result, KVS received large number of suggestions. Further, Teachers’ Transfer
Policies of the states of Gujarat, Karnataka, West Bengal, Tamilnadu, Delhi,
Rajasthan and Haryana were taken into consideration to carve out suitable and
appropriate transfer guidelines for the KVS employees.
2. You
would appreciate the fact that many meaningful suggestions received from your
side and many progressive elements of teachers’ transfer policies of above
mentioned states have been incorporated in KVS Transfer Guidelines 2016 to
fulfil the demands & aspirations of the KVS employees. I would like to
mention here some specific provisions made in new Transfer guidelines.

Introduction of Mutual Transfer,

Transfer against No Taker vacancy,
·
Prioritization of Widow & Single Parent for getting transfer
at a desired place,
·
Transfer of Yoga Teachers with post at choice place,
·
25 days relaxation in delayed joining at Hard/ Very Hard
stations for counting of tenure,
·
Consideration of KVS employee for request transfer after Mid-
Session on account of transfer of Spouse,
·
Exemption from displacement transfer to those employees who are
having disabled dependent children.
·
More points have been given to Members of JCM at KVS (HQ) &
Regional level to avoid their displacement transfers,
·
Points have been awarded for seeking request transfer for those
who are recipients of KVS Regional Incentive Awards.
·
A chance has been given to those employees who have been
redeployed on surplus ground for coming back to previous station in the event
of availability of vacancy within one year at that station.
·
An employee whose transfer orders are issued after 20th June by
the KVS for Hard/ Very Hard/ NER stations he/she will be given relaxation of
some more days for counting of tenure at Hard / Very Hard/ NER stations as on
30th June.
·
As the tenure for hard stations has been restored back for three
years w.e.f 2016 due to administrative exigencies but employees who had been
posted earlier with two years tenure at these stations have been exempted from
this change.
·
With a view to make whole annual transfer process fully
transparent, KVS has made a paradigm shift from old practice of manually filled
Transfer Applications. Henceforth, Transfer Applications will be invited
through online process and transfer orders will also be generated through
computerized process on the basis of online database.
·
Every employee will be able to check his/her Transfer Count and
Displacement Count on the KVS website as per the Calendar of Activities for
effecting annual transfer.
·
Tentative vacancies will also be displayed on website of KVS
(HQ) for the reference of employees.
3. I
would assure that KVS is committed to take care of all service matters of its
employees and to take all possible welfare measures. Kendriya Vidyalaya
Sangathan also expects from every one of us to rise to the occasion and to walk
some extra miles to secure the success of this wonderful organization.
4.

Sub: Travel by Premium Trains on LTC/Official Duty/Tour/Training/Transfer etc. – Clarification reg.
Attention is invited to DoPT O.M. No. 31011/2/2015 Estt.(A-IV) dated 2th January 2015 and Deptt. of Expenditure, Min of Finance, O.M. No. 19046/2/2008-E.IV dated 22/04/2015, it is clarified that travel by Premium Trains by Central Government servants on LTC/Official Duty/Tour/Training/Transfer etc. is not allowed and therefore, the fare charged for Premium Trains by the Indian Railways for the journey performed by Premium Trains shall not be reimbursable. In cases where journey on Official Duty/Tour /Training/Transfer etc. has already been performed by Premium Trains, the amount reimbursed shall be restricted to the admissible normal fare for the entitled class of train travel or the actual fare paid, whichever is less.
It is, therefore, once again impressed upon all concerned not to travel by premium trains on LTC/Official duty / Tour / Training/ Transfer etc. and Controlling / Countersigning Officers are requested to regulate the said claims in terms of the Govt. of India letters cited above.
