PAYMENT OF OVERTIME ALLOWANCE TO THE JEs-EASTERN RAILWAY

Dear Sir,
Sub: Payment of Over Time Allowance to the JEs (AC) performing running/ maintenance duties on Rajdhani/Shatabdi Trains-reg.
Ref: General Manager (Personnel), Eastern Railway’s letter No. E.740/0/Migo (Policy) dated 04/05/2017 to Railway Board.
On Eastern Railway, the Jr. Engineers (AC) GP 4200/- (6th CPC)/Pay Level 6 (7th CPC) are deployed to man Rajdhani/Shatabdi Trains along with the team of staff for ensuring safe and efficient maintenance standards. Unfortunately, these JEs are denied payment of Over Time Allowance since the last over three months, while the staff work under them on running maintenance are granted Over Time Allowance.
In the above context, the General Manager (P), Eastern Railway has addressed a letter to Railway Board vide No.E.740/0/Misc (Policy) dated 04/05/2017 seeking Railway Board’s approval for allowing payment of OTA to the Electrical JEs escorting the Rajdhani/Shatabdi Express Trains and discharging duties.
The Federation wants the Railway Board to appreciate that the role of Electrical JEs on Rajdhani/Shatabdi trains are not to be compared with other Supervisors so far as nature of duties are concerned as these JEs while discharging their duties of leading the team on Rajdhani/Shatabdi Trains, are always engaged and confined to their work under severe stress and tension to ensure safety, punctuality and efficient running and maintenance on the entire train formation to the comfort of passengers, thus they are not free to adjust their duties while on board, unlike those Supervisors who perform stationary duties. The CEE, Eastern Railway has also confirmed this view as mentioned in Eastern Railway’s letter dated 04th May 2017.
NFIR further states that the Board’s letter No.E(LL)70/HER/16 dated 04th January 1972 classifying Electrical Chargemen in scale Rs. 250-380 (AS) or above as Supervisor under HOER is not relevant to the category of Electrical JEs who perform duties on running trains i.e. Rajdhani and Shatabdi and whose duties are totally different to that of those Supervisors of GP 4200/Level 6 (7h CPC) performing duties in the Sheds/Depots.
NFIR, therefore, requests the Railway Board to accord approval for payment of OT Allowance to Electrical JEs escorting Rajdhani/Shatabdi Express Trains for ensuring running maintenance and accordingly issue instructions to the General Manager, Eastern Railway etc., to ensure payment of Over Time Allowance.

A doubt has been arisen regarding the entitlement of Overtime Allowance (OTA) tothe category of Junior Engineers in GP Rs.4200 (Level-6) working under Electrical Department deployed in Rajdhani/Shatabdi Exp. along with maintenance & AC staff. The matter has been considered in consultation with Electrical Department of this Railway (CEE/ER), keeping in view the extant guidelines mentioned as under:-
a.In terms of extant provisions laid down in RS (Hours of work and period of rest) Rules,2005, Railway servants classified as “Supervisors” and “Excluded” under Hours of Employment Regulations are holding a position of responsibility and are employed mainly in a supervisory character and comparatively free to adjust their hours of duty & work during such hours and are thus not entitled to overtime allowance.
b.As per Board’s letter no.E(LL)70/HER/16 dated 04/01/1972, the category of Electrical Chargeman in Rs.250-380 (AS) or above, in-charge of electrical examination and maintenance units has been classified as ‘Supervisor’ under HOER.
3.However, the CEE/ER is of view that nature of the duty of an Electrical JEs, as escorting Supervisors, is in no way comparable to those who are working as such on stationary duties because while discharging the duties of leading the team in a train like Rajdhani/Shatabdi Exp, they are always engaged and confined with their work under severe stress and tension to run train maintaining safety, punctuality and requisite passengers’ comfort and thus, not free to adjust their duty hours while on board. Hence they should be entitled to “Single (BARE) Rate Overtime”.
4.As the issue involves pan Indian Railways implications, Board is requested to examine the entitlement to OTA to Electrical JEs deployed in Rajdhani/Shatabdi Exp. to be calculated’ as per Para 2(c) of RBE No. 29/2010 in its true perspective and communicate the decision in this regard.
This issues with the approval of CPO (Admn.) and Accounts and in consultation with associated Accounts.

It has since been leamt from some of our cadres that reports appeared in the Media (Thiruvananthapuram etc.) that a union/Federation has withdrawn from the strike decision. This

report is not only false but also misleading. It is reiterated that the NJCA in its meeting held at New Delhi on July 1, 2016 has decided to meet on 06th July 2016 at New Delhi for taking appropriate decision.

It is hereby clarified that there is no change on Indefinite Strike decision of NJCA' Charter of Demands - Indefinite Strike from l lth July 2016-reg'

NFIR seeks better amenities for porters

Licensed porters should be entitled to privilege passes, their porterage charges should be increased and their services should be utilised on rotation basis for loading and unloading at the railway parcel offices, said general secretary of National Federation of Indian Railwaymen (NFIR) M. Raghavaiah.

Addressing hundreds of licensed porters, who came from different railway zones in the country to participate in the All-India Railway Licensed Porters Conference, at the Railway Institute here on Tuesday, Mr. Raghavaiah expressed concern at the dismal working conditions of railway porters. While welcoming the change in nomenclature of porters as ‘Sahayaks’, he called upon the Railways to provide them better amenities.

The struggles by NFIR had led to one time absorption of licensed porters as trackmen during the tenure of Railway Minister Lalu Prasad Yadav.

There are 36,000 porters over Indian Railway and they were seeking re-implementation of the same scheme to absorb them as gangmen. NFIR vice president K.S. Murty said that the union would strive to achieve better working conditions for railway porters.

Reception Committee chairman B. Krishna Kumar said that the railways had stopped utilising their services for loading and unloading of parcels and wanted it to be resumed so that they could get assured income.

The NFIR has been waging a relentless battle for achieving the demands of railway porters and it would continue to exert pressure on the present government at the Centre.

East Coast Railway Shramik Congress general secretary R.C. Sahoo, joint general secretary Tammineni Narasinga Rao and INTUC leaders participated.

Hospital Patient Care Allowance/Patient Care Allowance was introduced on the Railways in terms of Railway Board’s letter no. E(P&A)Il-98/HW-6 dt. 09.01.2008. As per paragraph 2 (a) (ii), of the letter dt. 9-1-2008 Pharmacists were also made eligible for grant of 1-lPCA/PCA subject to fulfilment of the conditions of admissibility except exclusive Store Pharmacists who were not involved in dispensing of medicines. Both the recognised Federations, namely AIRF and NFIR have raised the issue in the forum of PNM stating that there is no particular designation of Store Pharmacists in the Indian Railways. The matter has been considered in consultation with the Health Directorate of Railway Board and it has been decided to remove the exception made for exclusive Store Pharmacists in paragraph 2(a) (ii) in Railway Board’s letter no. E(P&A)ll-98/HW-6 dt. 09.01.2008. Phannacists will be entitled for payment of Hospital Patient Care Allowance I Patient Care Allowance. This would have effect from 01.01.2008 as mentioned in Railway Board’s letter no. E(P&A)li -98/HW-6 dt. 09.01.2008.
3. Other tenns and conditions would remain the same as per Board’s letter no. E(P&A)II – 98/HW-6 dt. 09.01.2008 and Board’s letter No. E(P&A)II-2013/AL-3 dt. 20.02.20 13.
4. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

Salary of 90% railway employees will be reduced after 7th CPC implementation

The recommendations of the seventh central pay commission (CPC) would reduce, rather than increase, the ‘take-home’ salary of almost 90% of Indian Railways’ workforce, the largest railway trade union has alleged. It has also threatened to go on an indefinite strike in the first week of March in response to the panel’s recommendations.

The National Federation of Indian Railwaymen (NFIR), which represents more than 90% of the railways’ workforce, has said 1.3 million railway employees are ‘seriously disturbed’ over what they call retrograde recommendations of the panel with regard to their pay structure as their take-home salary would be less than what they currently receive, particularly employees living in government accommodation.

“Those being covered against pay levels 1 to 12 of the seventh CPC Pay Matrix are approximately 90% of the workforce in the Indian Railways and these employees are seriously disappointed as their ‘take-home’ salary after 10 years waiting would be reduced ranging from Rs 2,000 to Rs 6,000 per month with effect from 1 January 2016,” NFIR said in a statement, without explaining how it arrived at the conclusion.

In a response to the “illogical” recommendations, the Union has threatened to go on indefinite strike in the first week of March after participating in a three-day Dharna at Jantar Mantar along with employees of Defence and Postal services.

“The Seventh CPC has done grave injustice to the employees in the Railways as well in the Central Government employees with regard to multiplying factor and computation of need based minimum wage,” the NFIR said, adding a comparison with earlier pay panels reveals several of the current pay commission recommendations are negative and illogical.
The recommendations are effective from the current month and would lead to total annual wage burden of Rs 28,000 crore, the government estimates.

The Union also said that the hike in wages in general will either be marginal or less than what is received now in most of the cases of employees. “Experience proved that successive Pay Commissions’ reports have resulted into pay anomalies since the age old relativities in pay scales got disturbed and those aberrations continued unresolved for decades as the authorities always prefer to procrastinate matters,” NFIR General Secretary M Raghavaiah said in a strongly-worded statement.

The trade union termed it ‘sad’ that the seventh CPC had not seriously gone into the skills requirement, nature of duties, accountability, remoteness and arduousness of over 1.3 million railway employees. It complained the Pay Commission has recommended abolition of various allowances and interest free advances in the Railways, generating serious unrest among the employees.
