DoPT denies Media News about extension of working hours of Central Government employees
The attention is drawn to the media news about extension of working hours of Central Government employees by the Department of Personnel and Training (DoPT), Ministry of Personnel, Public Grievances and Pensions, Government of India. It has been stated in the news item that Central Government employees’ working hours will be changed from 09.00 AM to 07.00 PM. It was also stated that the holiday of Saturday will also be done away with for the Central Government employees.
In this regard, the DoPT clarifies that there is no such proposal under consideration of the Central Government. The media news regarding the extension of working hours and abolition of holiday on Saturday for Central Government employees is false and baseless. There is no oral or unwritten order issued in this regard.

The Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh launched Online Vigilance System of Board and below Board Level Executives of Central Public Sector Enterprises (CPSEs) here today. He also launched e-Service Book of the Department of Personnel & Training (DoPT) employees on the occasion. The Cabinet Secretary Shri P K Sinha, the Additional Principal Secretary to the Prime Minister, Dr P K Mishra, Central Vigilance Commissioner Shri K. V. Chowdary, Vigilance Commissioners Shri Rajiv and Dr T. M. Bhasin, CBI Director Shri Alok Kumar Verma, Secretary CVC, Smt Nilam Sawhney, Chairman, Public Enterprises Selection Board (PESB), Shri Sanjay Kothari, Secretary, DoPT Shri B. P. Sharma, Secretary to the Prime Minister, Shri Bhaskar Khulbe and senior officers of DoPT were also present on the occasion.
Speaking on the occasion, Dr Jitendra Singh said the launch of the online vigilance system is indeed a breakthrough. He said this will bring transparency and accountability in the system. As we move ahead with this initiative, many practical issues will keep arising and they will be tackled in due course, he added. Referring to the launch of e-Service Book, Dr Jitendra Singh said that in the long run it is going to touch each and every Central Government employee in the country. He said that most of the issues arise out of Service Book related matters and delay in disbursement of pensions, which will be resolved by this initiative. Dr Jitendra Singh said that these initiatives are in tune with the Prime Minister Shri Narendra Modi’s mantra of ‘Maximum Governance and Minimum Government’.
The Central Vigilance Commissioner Shri K. V. Chowdary said that the online vigilance system will be updated regularly and it is a major step in the process of promotions and appointments and will bring transparency in the process. It will minimize the scope of any confusion, he said. The CVC said that this will also curtail the delay in the processes, the cases which used to take months will now be resolved in one or two days. He said that improvements will be brought in as and when needed.
The Online Vigilance System is a technology based mechanism introduced to obtain vigilance status of 120-130 Board Level executive appointments made annually of Central Public Sector Enterprises (CPSEs) timely, accurately and objectively so that process of their appointment is expedited. The system would enable efficient vigilance clearance of officers on real time basis who apply for these senior level posts. This system would facilitate CVC to decide on Vigilance Clearance early based on updated information. System will cover all CPSEs, Banking, Insurance and other Financial Institutions. The Online system will have modules for DoPT, CVC, CVO, CBI, PESB and ACC. To make the system secure, the Web portal has the feature of authentication of users from Ministries/Departments by DoPT and the users of CPSEs by the concerned Ministry/Department. The users can log in based on e-sign (OTP to be sent to the email/mobile every time). The system also maintains transaction log. The implementation of online vigilance status of board level executives of CPSEs would require feeding/updating of data pertaining to the details of employee’s vigilance profile, i.e. pending disciplinary proceedings, status of complaints received, details of prosecution sanction, Agreed List, ODI etc. at regular intervals. The data will be updated every month by the CVOs. After a series of sensitisation meetings, at present, 143 CPSEs and 26 Ministries have entered data related to 402 board level officers and 1799 below board level officers of CPSEs. This system would be operational on receipt of the ‘Security Certificate’.
The e-Service Book, launched by Dr Jitendra Singh, is a document to record all the events of a Government servant in his/her entire service period and career, recording each and every administrative action concerning the Government servant right from the stage of his recruitment till his retirement to reflect the history of service of a Government employee. The format of e-service book was finalised on December 5, 2016 and it was decided to roll it out in DoPT initially so that necessary changes if required can be made along with credentials of software. Accordingly data of 661 employees of DoPT got verified and details as such Aadhaar, mobile no, DoB, leave balance, LTC details, salary details, designations, photographs etc were updated. Physical service book of employees also got scanned and uploaded as legacy data. It is decided to integrate Personnel Information Management System (PIMS) with Public Financial Management System (PFMS) so that all financial data will flow from PFMS to PIMS (e-service book), in general terms in case of change in salary particulars due to promotion, increment, DA etc. Change made in one system will automatically reflect in other system which will reduce chances of errors etc. It has also been decided to develop all other applications impacting service book such as Promotions, Advances, Family declarations of employees etc. 27 such applications have been identified for development; out of this 12 applications will be developed by 31st May 2017 and remaining by 31st December 2017.
DoPT has successfully implemented e-service book of its 661 employees and is now taking concrete steps to roll out of e-service book in respect of all Central Govt. employees in a time bound manner with the support of NIC and involvement of Cadre Controlling Authorities. In this regard a workshop of all Cadre Controlling Authorities (CCAs) is being organised in April 2017 to discuss roll out plan in all Ministries and Departments.
E-service book for all the employees working in attached offices, subordinate offices and autonomous bodies for which DoPT is administrative department would be undertaken shortly and it will be completed for approximately 10,000 employees by 30th June 2017. It is planned to roll out e-service book of all civilian employees (approximately 41 lakh) of Govt. of India by 31st March 2018 in consultation with all CCAs.
The launch of e-Service book is expected to bring many positive outcomes. The shift to electronic service book would free up significant manpower to concentrate on core works of the Department. It will lead to stoppage of physical movement of Service Book and other documents between the Departments that will save time of the organisation and problem of missing Service Book will be eliminated. This will also enable timely verification of Service Book that will facilitate timely processing and finalization of pensions. Availability of centralized data will enable government for policy research and planning as educational qualifications and other competencies and deficiencies may be easily obtained. It will enable Government to take transfer and posting decisions more pragmatically based on reliable first hand data.

Make Pensioners part of nation building process, says Minister
The Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh chaired the 29th meeting of the Standing Committee of Voluntary Agencies (SCOVA) here today. The SCOVA meeting is organised by the Department of Pensions & Pensioners’ Welfare (DoP&PW), Ministry of Personnel, Public Grievances & Pensions and the last such meeting was held on June 27, 2016.
During the meeting, Dr. Jitendra Singh said that today’s interaction was very meaningful and stimulating, thus reflecting on the working of DoP&PW. The Minister said that there are about 50-55 lakh pensioners in the country and almost 88 percent of pension accounts have been seeded to Aadhaar. He further said that minimum pension has been increased to Rs. 9000 per person and ex-gratia amount has been increased from Rs. 10-15 lakh to Rs. 25-35 lakh.
Dr. Jitendra Singh said that we need to put in place an institutionalized mechanism to make good use of the knowledge, experience and efforts of the retired employees which can help in the value addition to the current scenario. Dr. Jitendra Singh said the retired employees are a healthy and productive workforce for India and we need to streamline and channelize their energies in a productive direction. We should learn from the pensioners’ experience, he added. The Minister also said that the DoP&PW should be reoriented in such a way that pensioners become a part of nation building process.
In the meeting, discussions were held on the action taken report of the 28th SCOVA meeting. Further many issues related to pensioners were discussed threadbare, such as revision of PPOs of pre-2006 pensioners, Health Insurance Scheme for pensioners including those residing in non-CGHS area, Special "Higher" Family Pension for widows of the war disabled invalidated out of service, Extension of CGHS facilities to P&T pensioners, issue relating to CGHS Wellness Centre, Dehradun etc. The Minister directed for the prompt and time bound redressal of the grievances of the pensioners and said that we should have sympathetic attitude towards them.
The Secretary, DoP&PW, Shri C. Viswanath and other senior officers of the department were also present on the occasion. The meeting was also attended by the member Pensioners Associations and senior officers of the important Ministries/Departments of Government of India.

The Minister of Women and Child Development, Smt. Maneka Sanjay Gandhi held a review meeting on implementation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 in New Delhi today. Officials from the WCD Ministry, DoPT, Ministry of Youth Affairs & Sports, Ministry of Home Affairs, Ministry of Railways and Department of Financial Services were present. Smt. Maneka Sanjay Gandhi expressed her concern that the complaints of sexual harassment are not being handled in a timely as well as sensitive manner. She also expressed her concern that harassment often continues over a period of time and it is only after it becomes unbearable that a woman comes out to complain. In such situations, it is the duty of Internal Complaints Committee to decide on the complaint in the shortest possible time. The Minister also pointed out that the transfer of the aggressor can never be a solution to such a complaint and there should be harsher punishments when the complaint is found to be true.
2.After extensive deliberations, the following decisions were taken:
(i)The Ministry of WCD will set up an inter-ministerial committee headed by a senior official of the WCD Ministry. This committee will review the progress of disposal of complaints of sexual harassment, get a standardized training module prepared in collaboration with ISTM, ensure that heads of Internal Complaints Committee of all ministries/departments are given training on how to handle the complaints.
(ii)The ministry will be establishing a secure electronic platform for any woman employee of the government to file a complaint under the Act directly to the Ministry of WCD. These complaints will be then taken up with the respective ministries/ departments. This will enable a monitorable and transparent system of grievance redressal under the Act.
(iii)All ministries/ departments will furnish a monthly report to WCD ministry on the number of complaints received, disposed, pending and action taken etc.
(iv)All ministries/ departments and attached offices will furnish the annual statistics of complaints received and disposed under the Act in their Annual Reports. It was also decided that the inter ministerial committee will create a panel of resource persons from which ICCs can take the external members. In another important decision taken at the meeting today, all the training programmes of all services will have a module on the Act and DoPT will issue necessary instructions for this.
(v)It was also decided that the respective cadre controlling authority will keep every complainant under observation for a period of five years so that she is not subjected to any further administrative harassment as a result of her having complained against a male superior.
(vi)It was agreed that the Act, the rights of a woman official and the responsibility of the ICC must be given adequate publicity through different methods including the websites of the ministries/ departments/ attached offices.

A delegation of the Central Secretariat Stenographers' Service (CSSS) Association, called on the Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh here today and sought his intervention for parity in pay fixation and related issues.
The delegation led by Shri Raj Kishore Singh submitted a memorandum listing details of their long pending issues and suggesting options to resolve the same. According to the memorandum, while applying Rule 8 of CCS (RP) Rules 2008, the pay of direct recruits and new entrants is fixed at higher stage, when compared to the existing employees who were promoted in the same grade. This leads to discrimination in the fixation of pay of Personal Assistants of one category vis-Ã -vis the other category.
The memorandum also stated that the issue has been lingering on in the National Anomaly Committee for the last four years, but it has not been addressed. It pleaded that the mechanism of grant of “stepping up” to certain employees should be provided only in exceptional cases and not resorted to as a routine matter to sort out discrepancies which may affect a large number of employees.
Members of the delegation suggested that their issue can be addressed by incorporating a new provision in the Rules wherein if a promotee’s pay is getting fixed at a stage lower than that of a direct recruit, then the pay of the promotee should be fixed at the same stage as that of a direct recruit / new entrant. The other option suggested by them was to amend the CCS (RP) Rules so as to appropriately fix the pay in the Pay Band for a particular post carrying a specific Grade Pay.
Dr Jitendra Singh gave a sympathetic hearing to the members of delegation and assured them that DoPT will try to sort out their issue to the maximum extent possible.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Fulfillment procedural requirements.
The undersigned is directed to refer to para 8 and 9 of the Guidelines enclosed in this Department’s O.M. of even number dated 18.2.2016 on the above noted subject and to say that the issues have been revisited in consultation with the Department of Expenditure. It has been decided that the cases where a Government servant travels on LTC upto the nearest airport/railway station/ bus terminal by authorised mode of transport and undertakes rest of the
journey to the declared place of visit by private transport/own arrangement, may be dealt with as
follows:-
(i) When public transport is available between the nearest airport/railway station/ bus terminal and the declared place of visit:-
The Government servant may also be reimbursed the fare incurred for completion of journey to the declared place of visit by own arrangement. This will be restricted to the fare admissible for journey by otherwise entitled mode of public transport from the nearest airport/railway station/ bus terminal to the declared place of visit. The Government servant shall be required to submit an undertaking that he has actually visited the declared place of visit.
(ii) Where no public transport is available between the nearest airport/railway station/ bus terminal and the declared place of visit:-
(a) In case he does not wish to claim reimbursement for the part of the journey which he has undertaken by his own arrangement, he may be reimbursed for the part of the journey which he has undertaken by public transport. The Government servant shall be required to submit an undertaking that he has actually visited the declared place of visit.
(b) Where the Government servant claims assistance for the entire journey, the part of the journey where he has used his own arrangement would also be reimbursed as per his entitlement for journey on transfer. The Government servant shall be required to submit an undertaking that he has actually visited the declared place of visit.
2. In case of (b) above, the Government servant shall be required to submit a certificate that the mode of transport used by him operates from point to point on regular basis with the approval of the State Government/Transport authorities, and is authorised to ply as public carrier.
3. Above certificate need not be insisted upon in case information to the effect that (i) no public transport is available in a particular area, (ii) list of transport operators who operate on regular basis from point to point on regular basis with the specific approval of the State Government/Transport authorities, is available on the website of a State/Central Government or a State or Central PSU or in a current publication brought out by these authorities.

The undersigned is directed to refer to this Department's O.M. of even number dated 11 th October, 2015 on the subject mentioned above whereby it was informed that the last date of furnishing of information relating to assets
and liabilities by public servants under section 44 of the Lokpal and Lokayuktas Act, 2013 was extended upto 15.04.2016.
2. In this regard, it is stated that there shall be no further extension of the
aforesaid last date i.e. 15.04.2016.
3. The formats to be used for submission of these returns to competent authorities have already been communicated to all concerned vide para-3 of OM of even number dated 18.03.2015. However, a copy of the same is enclosed for ready reference.
4. In this regard, it is informed that :-
i. The first return as on 1st August, 2014 under the Lokpal and Lokayuktas Act, 2013 should be filed on or before the 15th April, 2016
ii. The next return as on 31st March, 2015, under the Lokpal and Lokayuktas Act, 2013 should be filed on or before the 15th April, 2016.

OFFICE MEMORANDUM
Subject: Court orders against Government of India
instructions on service matters-consultation with Ministry of Law and
Department of Personnel and Training on question of filing appeals.
The undersigned is directed to refer to this Department’s
0.M.No.28027/9/99- Estt.(A) dated 1st May, 2000 on the above subject ( copy
enclosed) and to say that the Department of Personnel and Training is the nodal
Department that formulates policies on service matters and issues instructions
from time to time. These instructions are to be followed by the
Ministries/Departments of the Central Government scrupulously. All the Court
cases filed by employees have to be defended on the basis of the facts
available with the Administrative Ministry/Department concerned, keeping in
view the instructions issued on the subject by this Department.
2. Reference is also invited to the Cabinet Secretariats D.O
letter No. 6/1/1/94- Cab dated 25.02.1994 and the Department of Expenditure’s
O.M. No. 7(8)/2012-E-II(A) dated 16.05.2012 inter-alia provide that (i) a
common counter reply should be filed before a Court of Law on behalf of the
Union of India by the concerned administrative Department/Ministry where the
petitioner is serving or has last served; and (ii) a unified stand should be
adopted instead of bringing out each Department’s/Ministry’s point of view in
the said reply. It further provides that it is primarily the responsibility of
the Administrative Ministry to ensure that timely action is taken at each stage
a Court case goes through and that a unified stand is adopted on behalf of
Government of India at every such stage. In no case should the litigation be
allowed to prolong to the extent that it results in contempt proceedings.
3. However, it is noticed that the Ministries/Departments are
making several references to this Department seeking interpretation of the
guidelines without exercising due diligence. The Ministries/Departments are
advised not to make any references to this Department unless there are
difficulties relating to interpretation/application of these guidelines or any
relaxation in Rules/instructions is warranted to mitigate a genuine hardship
faced the Government servant.
While seeking advice of this Department, instructions contained in
this Department’s O.M. number 43011/9 /2014-Estt (D) dated 28.10.2015 may be
followed.
4. The court cases may be further handled in the

The engineers are apparently upset over the Seventh Pay Commission, which did not grant them the Group B status despite a notification by the Department of Personnel and Training to treat Railway JEs and SSEs on par with their counterparts in other central government departments.
“The protest will be organised under the banner of All India Railway Engineers Federation (AIREF) at all zonal and divisional offices in country and a memorandum addressed to the Railway Minister and the Railway Board Chairman will be submitted,” National Organisation Secretary V K Badgaiya told on Tuesday.
Badgaiya said all engineers will go on mass leave on Wednesday as a symbolic protest.
“As per the DOPT gazette notification no. 605 dated April 9, 2009, JEs/SSEs working in Railways should be accorded Group B status on par with their counterparts in other central government departments, but it was not implemented in railways,” Badgaiya claimed.
“The notification clarified that all civil posts, for which the grade pay was above Rs 4,200, are eligible to be included in the Group B category. But it was denied to the Railway JE/SSE cadre by the Seventh Pay Commission,” he claimed.
Despite working tirelessly and playing an important role in railways’ operations, the Seventh Pay Commission has kept us on par with railways nurse, pharmacist and accounts cadres who just work for six hours a day in air-conditioned cabins, he alleged.
He said they had earlier also staged a protest at Jantar Mantar in Delhi on December 2. The Federation had then warned of intensifying the stir if their demands were not fulfilled by the railway administration.
The JEs and SSEs are responsible for the safe operation of trains by constantly maintaining track, signal, engine, coach, electric line and bridges across the country and they only grant fitness certificate to trains for operations.
AIRF goes on all-Indian Railway strike
Threatening to go on “indefinite strike”, All-India Railwaymen’s Federation (AIRF) today raised various demands including review of new pension scheme and filling up of large number of vacant posts in the railways.
“We will conduct a secret ballot on Februray 11 and 12 to decide the date and future course of action (on strike),” AIRF General Secretary Shiv Gopal Mishra said here today.
He said if railway employees will cast their votes in favour of launching indefinite strike then we will go for it and accordingly a date would be announced.
Currently, he said, there were about 2.5 lakh posts including those of loco pilots, assistant station masters and track men lying vacant in railways.
Mishra also differed with the 7th Pay Commission reports and said “the minimum wage should be increased from Rs 18,000 per month to Rs 26,000.”
According to the 7th Pay Panel recommendations, there would be an additional burden of Rs 32,000 crore on railways and Railway Minister Suresh Prabhu has described it as “unbearable”.
On new pension scheme, he said, “it should be reviewed as there are many anomalies in it. We want the guranteed pension scheme should be implemented.”
In order to make the proposed agitation a success, Mishra said a sustained awareness campaign will be launched from January 25 to February 10.
NFIR flays 7th Pay Commission recommendations as ‘retrograde’ proposals
he recommendations of the Seventh Central Pay Commission (7th CPC) would reduce, rather than increase, the “take home” salary of 90 per cent of the Indian Railways’ workforce, the largest railway trade union has alleged. The recommendations are effective from the current month and would lead to a total annual wage burden of Rs 28,000 crore, the government estimates.
The National Federation of Indian Railwaymen (NFIR), that represents more than 90 per cent of the railways’ workforce, has said 1.3 million railway employees are “seriously disturbed” over what they call retrograde recommendations of the panel with regard to their pay structure as their take-home salary would be less than what they currently receive, particularly employees living in government accommodation.
“Those being covered against pay levels 1 to 12 of the seventh CPC Pay Matrix are approximately 90 per cent of the workforce in the Indian Railways and these employees are seriously disappointed as their ‘take home’ salary after waiting 10 years would be reduced ranging from Rs 2,000 to Rs 6,000 per month with effect from January 1,” NFIR said, without explaining how it arrived at the conclusion.
It added the hike in wages will either be marginal or less than what is received now, NFIR general secretary M Raghavaiah said.
In response to the “illogical” recommendations, the union has threatened to go on an indefinite strike in the first week of March after participating in a three-day dharna at Jantar Mantar along with employees of Defence and Postal services. “The 7th CPC has done grave injustice to the employees in the Railways as well in the Central government employees with regard to multiplying factor and computation of need based minimum wage,” NFIR said, adding a comparison with earlier pay panels reveals several of the current recommendations are negative and illogical.

The railway employees staged the protest in response to a call given by the Karnataka Joint Council of Action of Central Government Employees for a three-day protest from Tuesday to Thursday. Various Union government employees unions have come under the umbrella of the Joint Council of Action to fight for their demands.Staging the protest in front of the office of the Divisional Railway Manager of Hubballi Division, the protesters alleged that the Union government had failed to address their grievances and fulfil their demands. They urged the Union government to look into the charter of demands, which contains 26 of them.
Some of the demands are minimum wages of Rs. 26,000; revision of pay matrix based upon minimum wages; filling vacant posts; scrapping of national pension scheme (NPS); revision of Union government employees every five years; and withdrawal of stipulated ceiling on compassionate appointments.
As per the protest plan of the joint council, the protests would be held at the office of the Divisional Railway Manager of Bengaluru Division in Bengaluru on Wednesday and in front of the Defence Office near TV Tower in Bengaluru on Thursday.

The undersigned is directed to refer to the subject and to say that it has come to notice of this Department that there are instances of a long time lag between the date of advertisement for the vacancy and date of examination or interview. This delay may deny the opportunity to fresh candidates who become eligible during that period, while creating an atmosphere of uncertainty to candidates who have applied. .
2. All Ministries / Departments are, therefore, requested that while initiating the recruitment process to fill vacant posts(s) by the method of direct recruitment in theirMinistries / Departments, it may be ensured that the entire recruitment process

Dr Jitendra Singh asks States to expedite process of abolishing interviews
Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh has asked the State Governments to expedite the process of abolition of interviews for recruitment to all such government jobs where it is not essential.
Addressing a one-day workshop of Principal Secretaries of General Administration Department (GAD) / Personnel from different States and Union Territories, here today, Dr Jitendra Singh observed that soon after the Prime Minister Shri Narendra Modi made an announcement to this effect on Independence Day from the ramparts of Red Fort, the Department of Personnel & Training (DoPT) had immediately moved on a fast track and fixed for itself the deadline of December 31, 2015 to abolish the practice of conducting interview for appointment to Group ‘B’ and Group ‘C’ posts in various Ministries/Department and other organizations including Public Sector Undertakings (PSUs) under the Central Government. On September 4, 2015, Secretary DoPT wrote to the Chief Secretaries of all the States and this was followed by a two-day Workshop in the national capital on September 8-9, 2015.
Dr Jitendra Singh recalled that he had personally written D.O.Letters to Chief Ministers of all the States on September 29, 2015 requesting them to take the lead in carrying forward this initiative. While some of the States have already made a big headway in this exercise, there are other States which seem slow in response, but were expected to take the matter seriously and on fast track, he said. In his letter to the Chief Ministers, he had also requested to involve Public Service Commissions and other recruiting agencies in their respective States to identify the posts for which interview can be discontinued, he added.
Dr Jitendra Singh said the objective behind the abolition of interview for appointments where it is not required was to ensure more objective selection in a transparent manner without causing disadvantage to poor or resourceless aspirants. This is one of the several path-breaking decisions taken by the DoPT during the last 17 months, which also include the abolition of attestation of certificates with introduction of self-attestation of certificates and the decision to revisit/revise the pattern and syllabus of IAS/Civil Services Examination, he added.
Secretary DoPT Shri Sanjay Kothari and other senior officers of DoPT conducted the various sessions of the day-long workshop.

Subject:- Instructions / guidelines under rule 7(2) of AIS(Leave) Rules 1955 to process deemed resignation for being unauthorisedly absent after expiry of Leave / Study Leave/ Foreign Assignment etc.
Sir/Madam,
The following procedure shall be followed in the cases of unauthorized absence and to initiate proceedings of deemed resignation under rule 7(2) of AIS(Leave) Rules 1955:-
(a) A Member of Service (MoS), if remains unauthorisedly absent after the sanctioned period of leave / study leave / tenure of Foreign Assignment as prescribed under rule 7(2) of AIS(Leave)Rules, 1955, there shall be a one month waiting period after the end of leave period / tenure of foreign assignment etc. After that the concerned State Government shall issue a show cause notice, thereby giving an opportunity to the MoS to explain his / her case. Thereafter, if the MoS does not return to duty, the State Government concerned shall initiate proceedings of deemed resignation under rule 7(2) of AIS(Leave) Rules 1955 and forward a complete proposal to the Central Government for effecting deemed resignation within next two months. If the State Government fails to comply with these instructions and does not adhere to the aforesaid timeline, the Central Government shall initiate proceedings of deemed resignation under rule 7(2) of AIS(Leave) Rules 1955 on its own. The term ‘Central Government’ means the concerned Cadre Controlling Authority, i.e. Department of Personnel & Training for IAS officers, Ministry of Home Affairs for IPS officer and Ministry of Environment, Forest & Climate Change for IFS officers respectively.
(b) However, there is no bar in issuing show cause notice and seek clarification from MoS for being unauthorisedly absent any time during one year period of unauthorised absence or as otherwise provided under rule 7(2)(a) & (b) respectively. But after period of one year of unauthorised absence or as otherwise provided under rule 7(2)(a) & (b) respectively, the whole process of deemed resignation shall be completed within three months as prescribed above.
2. The above instructions / guidelines may please be brought to the notice of all the concerned authorities under your administrative control for strict compliance.
3. This issues with the approval of Competent Authority.

Subject: Processing of files referred to DOP&T for advice/clarification-procedure to be followed.
This Department has from time to time issued instructions prescribing the procedure to be followed for making references to this Department for advice/clarification. In this regard, 0.M.No. 20034/2/2010-Estt(D) dated 13th August, 2010, 0.M.No.20034/2/2010-Estt(D) dated 30th November, 2011 and OM of even number dated 13.02.2015 refers.
2. Inspite of these instructions, some Ministries/Departments continue to refer the files to this Department without following the procedure enunciated in the above mentioned OMs, resulting in avoidable procedural delays, grievances and unwanted litigations.
3. In this background while reiterating instructions mentioned in the above three OMs, the following procedure for referring the proposals including court cases to this Department, may be followed:-
i. Administrative Departments shall refer cases to the DoPT only where there is a specific point which is either not covered by prevailing policies/guidelines/rules/regulations or interpretation of a specific clauses/provisions in the said policies/ guidelines/rules/regulations is involved for a particular case.
ii. When such a reference is made, all facts pertaining to the case may be incorporated in the Self Contained Note.
iii. All the references should be made to DOP&T with the approval of the Secretary of the Administrative Ministry/ Department. These references should be sent atleast two weeks in advance so that it can be properly examined in DoP&T.
iv. The concerned Ministry/Department, which sends the proposal should indicate the Division within DoPT where it has to be dealt with and also to the concerned Joint Secretary/Director so that there is no delay in processing within DoPT.
v. While sending the proposal, the name, designation of the Joint Secretary/Director (Phone number and e-mail id) who can be contacted for further correspondence may also be indicated.
4. The content of this O.M. may be given wide publicity and brought to the notice of all concerned and will be applicable from 1st November, 2015.
