NATIONAL COUNCIL OF JOINT ACTION 

PRESS STATEMENT

24.06.2016 

The central Government Employees working in and around Delhi at the call of  NJCA held a massive Rally  on 24.06.2016 before the Parliament house. The Rally was organized to declare the resolve and determination of the Central Government Employees to organise Strike action commencing from 11th July 2016, if the NDA Government does not bring about a satisfactory settlement of the 11 point charter of demands (copy enclosed).

Two of the most significant issues that have triggered the strike action are:

(i)the inordinate delay in taking decisions on  the 7th CPC recommendations;

(ii)the refusal of the Government to bring back the old statutory  defied Benefit scheme of pension to all CGEs in the place of Contributory Pension Scheme.

The report of the 7th CPC was submitted on 19.11.2015 after a delay of about 3 months. The Government especially the Finance Minister had assured that the final decision over the report will be taken within 4 months. On 19th June 2016, the delay has crossed seven months.

There had been no meaningful discussions with the NJCA so far. The computation of Minimum wage by the 7th CPC deserves to be rejected as the commission has, in a bid to suppress the entitlement doctored the formula itself. The wages of an MTS in civil service, who is a group C employee cannot be less than Rs 26000 on the basis of the formula evolved in 1957 to which the Government is a party. There can not therefore be any question of reduction in the quantum of minimum wage.

 The NPS, which the Government introduced for those retired after 1.1.2004 in Government service has to be construed as a fraud perpetuated and deserves to be abandoned. There cannot be two classes of civil servants in the country; one making contribution but still not getting any assured pension and the other entitled for a statutory defined pension without any contribution. Those who are covered by the NPS in Central Civil Service is now more than 40% of the total personnel. The Government must be bold enough to address this issue. 

It is high time, that the Government comes forward, hold meaningful and fruitful discussion with NJC and settle the 11 point Charter of demands. The continued procrastination is a sure step to confrontation and the Central government employees in the Country will certainly commence the strike  action from 11.7.2016.

The entire civil service, which include the Railways and Postal workers,  employees of Defence factories and establishments and all other services of the Government of India will come to a grinding halt on  11.7.2016.

The rally  which was concluded at 3 PM was addressed by leaders of Railways and Defence Federations and Confederation of CGEs and Workers.












CHARTER OF DEMANDS 

1. Settle the issues raised by the NJCA on the recommendations of the 7 CPC sent to Cabinet Secretary vide letter dated 10th December 2015.

2. Remove the injustice done in the assignment of pay scales to technical/safety categories etc. in Railways& Defence, different categories in other Central Govt establishments by the 7 CPC.

3. Scrap the PFRDA Act and NPS and grant Pension/family Pension to all CG employees under CCS (Pension) Rules, 1972 & Railways Pension Rules, 1993.

4.
i. No privatization/outsourcing/contractorisation of governmental functions.
ii. Treat GDS as Civil Servants and extend proportional benefit on pension and allowances to the GDS.

5. No FDI in Railways & Defence; No corporatization of Defence Production Units and Postal Department.

6. Fill up all vacant posts in the government departments, lift the ban on creation of posts; regularize the casual/contract workers.

7. Remove ceiling on compassionate ground appointments.

8. Extend the benefit of Bonus Act,1965 amendment on enhancement of payment ceiling to the adhoc Bonus/PLB of Central Government employees with effect from the Financial year 2014-15.

9. Ensure Five promotions in the service career of an employee.

10. Do not amend Labour Laws in the name of Labour Reforms which will take away the existing benefits to the workers.

11. Revive JCM functioning at all levels.

OROP notification: Major General (retd) Satbir Singh, leader of the protesting veterans, claimed a case will be filed by Jethmalani on OROP demand in the Supreme Court in next 3-4 days and he will not charge any fee. He said four more cases have been filed in the armed forces tribunal. “These cases pertain to rulings for jawans, war widows, arrears since 2006, payments for honorary ranks, rounding off of disability pension, and payments of reservists,” he said. The veterans’ protest at Jantar Mantar entered its 320th day today.
Protesting ex-servicemen tonight suspended their 320-day-old agitation for complete implementation of One Rank One Pension (OROP) as senior lawyer Ram Jethmalani assured them of leading their legal battle in the apex court. (PTI)

“Now that we have suspended the agitation, we believe that Parrikar will now keep his promises made to us,” said Col (retd) Anil Kaul, spokesperson of the ex-servicemen movement. (PTI)
NEW DELHI: Protesting ex-servicemen suspended their 320-day-old agitation for complete implementation of One Rank One Pension (OROP) on Friday as senior lawyer Ram Jethmalani assured them of leading their legal battle in the apex court. “The indefinite relay fast has been suspended now as we will be taking the legal recourse. Defence minister Manohar Parrikar had said that proverbial gun was been held to the head of the government by virtue of our presence at Jantar Mantar.
“Now that we have suspended the agitation, we believe that Parrikar will now keep his promises made to us,” said Col (retd) Anil Kaul, spokesperson of the ex-servicemen movement. Addressing armed forces veterans staging protest at Jantar Mantar in the national capital, Jethmalani said he would fight their case in the Supreme Court.  “I am 93-year-old and I can die any day but I assure you that it will not happen before I get you justice from the Supreme Court,” Jethmalani said.

DMRC Staff say their demand for Salary Restructuring not yet been met

New Delhi: The Delhi Metro Rail Corporation has hit rough waters with its employees resorting to protests once again. The protesting non-executive employees of the corporation have now begun a hunger strike as they claim their demands for salary restructuring are going unheard by the administration.

As many as 3,600 employees, mainly technicians, are taking turns to protest at Jantar Mantar and at the seven metro depots. They are not ruling out train services being affected as 32 of those on hunger strike have already been hospitalized. Members of the staff council are likely to meet the administration on Monday to reach a common consensus.

They demand that the salaries of technicians be revised from Rs 8,000 – 14,140 to Rs 10,170 – 18,500. For senior technicians, they have demanded a hike in pay-scale from Rs 10,170 – 18,500 to Rs 14,000 – 26,950 and for head technicians from Rs 14,000 – 26,950 to Rs 16,000 – 30,770.

According to General Secretary, DMRC Employees Union, Kuldeep Maan, the employees fear that once the Seventh Pay Commission is implemented, their problems with the corporation would be quashed. “We have been victims of DMRC’s exploitation since 2007. Our protest has been on for long now but nothing has happened. On November 3, we decided to extend the protest to Jantar Mantar and November 5 onwards employees began their hunger strike,” he said.

To register his protest for the cause Kishan went a step ahead and resigned from his membership of the employees’ council. “So far, 32 of the many employees on hunger strike have been hospitalised. If the administration does now blink an eye many more will be taken ill and then we won’t be responsible if metro operations are hit,” said another protesting member. The administration had called for a meeting once, but it bore no fruitful conclusions, he added.

Responding to the report, the DMRC said, “It is an internal matter of the organization and the Human Resource department has taken up the issues of these employees.”

Delhi Metro to rent out Office Space in Delhi

New Delhi: Facing an acute financial crisis, the Delhi Metro Rail Corporation (DMRC) is focusing on property development to generate more revenue.

The DMRC has decided to come up with a commercial complex in the heart of the city near Jantar Mantar where it will rent out space for offices.

A DMRC official said that a notification from the Ministry of Urban Development on changes in the Transit Oriented Development Policy (TOD) has also paved the way for vertical growth along the Delhi Metro corridor, which will eventually help them to use more space for commercial purposes.

Under the TOD policy, a floor area ratio (FAR) of 400 has been approved.

This will enable highrises to come up in these areas and make for denser colonies. TOD colonies can come up in the ‘influence zone’ of the Metro which extends to 500 metres on both sides of the corridor.

“We have a property near Jantar Mantar where we will construct a four-floor commercial complex and rent it out to generate more revenue. Also the increase in FAR will help us to use more area for commercial activities. We have space for shops at Jhilmil, Mansarovar Park, Vaishali, Mayur Vihar phase one and Dwarka metro stations,” said a DMRC official.

DMRC says that the demand for office space in New Delhi is high and can generate good revenue.

“We will prepare a brochure for the complex and people willing to have an office there can book it in advance. The construction will start only after receiving sufficient booking,” the official added.

According to officials, TOD focuses on a more sustainable land use by minimizing travel time for citizens, promoting use of public transport, reducing pollution and congestion, creating more homogeneous neighborhoods, having work places near residences, creating public amenities within walking distances and providing a safer environment.

As per the policy, it will be mandatory to use a minimum of 30% of overall FAR for residential use, a minimum of 10% of FAR for commercial use and a minimum of 10% of FAR for community facilities.

As much as 20% of the land will have to be used for roads/circulation areas.

Uproar in Jaipur as Underground Metro puts Heritage Sites at Risk

Jaipur (JP): Protests are on in the Pink city against the plan to bring Jaipur Metro right into the 300 year old walled premises of the old city. Residents and experts alike, feel that the underground metro would be destructive to old monuments like Hawa Mahal, Jantar Mantar and Isar Lat.

“The vibration could also lead to cracks in Hawa Mahal and Jantar Mantar. As everybody has been talking about Hawa Mahal is not a very solid structure, it has got walls and its foundation isn’t deep either. Suddenly you have something which doesn’t belong there, a metro. It’s a shame,” Convenor INTACH Jaipur Dharmendar Kanwar said.

The metro project was begun by the previous Ashok Gehlot government but the present Vasundhara Raje government has decided to go ahead with the underground phase despite warnings from the Archaeological Survey of India. However, Raje is blaming the previous Congress government for the project.
