Clarification on Recently Notified Maternity Benefit (Amendment) Act,2017
The Government has notified the Maternity Benefit (Amendment) Act,2017 on 28th March,2017 and the provisions of the Amendment Act have come into force with effect from 1st April,2017, except those relating to crèche facility {Section 4(1)} which would come into force from 01.07.2017.
Keeping in view queries received from various quarters, the Ministry of Labour & Employment, on 12.04.2017, had issued certain clarifications on various provisions of Maternity Benefit (Amendment) Act, 2017. One of the clarifications issued by the Ministry stated that the enhanced maternity benefit, as modified by the Maternity Benefit (Amendment) bill, 2016 can be extended to women who are already under maternity leave at the time of enforcement of this Amendment Act.
Having received further queries and to remove doubts, it is further clarified that it is mandatory on the part of employers to extend the benefit of enhanced maternity leave to those women workers who were already on maternity leave on the date of enforcement of the Maternity Benefit (Amendment) Act,2017 i.e. as on 01.04.2017.

New Delhi, May 8 (PTI) Labour Minister Bandaru Dattatreya today clarified that the retirement fund body EPFO will not construct houses, but become a facilitator for its over four crore members so that they can buy homes.
Labour Ministry intends to facilitate at least 10 lakh subscribers in the period of next two year by allowing them to use 90 per cent of EPF accumulations to make down payments to buy houses and use their accounts for paying EMIs of home loans.
"For housing, the EPFO has nothing to do with construction of houses. It is their (subscribers) responsibility," Dattatreya replied when asked whether the Employees' Provident Fund Organisation (EPFO) would build low cost homes for their subscribers.
Elaborating further about the recent amendment in the Employees' Provident Fund Scheme 1952 for facilitating members to buy homes, the minister said, "The scheme also aims to fulfil the Prime Minister's vision of 'Housing for All By 2022'. Our EPFO subscribers will be the beneficiary of this scheme. We have 4.31 crore EPFO subscribers. We have framed norms for forming group housing societies."
Earlier, certain section of media had reported that the EPFO will build 10 lakh homes in the next two year time for its subscribers and the body would join hands with Ministry of Urban Development for the purpose.
The minister said, "The scheme can be availed by the subscribers getting monthly basic wages of below Rs 15,000.
The scheme will be aligned with the urban development ministry (programmes) and other organisations because Government of India is also giving subsidy of Rs 1.5 lakh to weaker sections (to buy houses)."
He said that the government is also providing interest subsidy for certain section of people for buying home and all benefits can be clubbed together.
The minister also talked about the proposal of raising wage ceiling for coverage under the EPFO from existing Rs 15,000 to Rs 25,000, which would be shortly taken up in next meeting of body's trustees.

EPF members now required to submit self-declaration for advance in case of illness of members/ dependents
EPF members will now only be required to submit a self-declaration for the advance in case of illness of members/ dependents. Differently abled members will also get advance on the basis of self-declaration. A member will no longer be required to submit any medical certificate or any other certificate or document or proforma whatsoever to avail advances under paragraph 68-J or under paragraph 68-N of EPF Scheme 1952.
Ministry of Labour & Employment has amended Paragraph 68-J and Paragraph 68-N of Employees’ Provident Fund Scheme, 1952 and It will come into force from the date of its publication in the official Gazette. According to it, a member would only be required to submit a self-declaration, which has already been included in the composite claim form, to avail advance under the EPF Scheme in case of illness of members/ dependent and also in case of differently abled members.
This is in continuation of initiatives taken by EPFO as part of next phase of its e-governance reforms with a view to make the services of EPFO available to its stakeholder in an efficient and transparent manner. An administrative order was issued on 20.02.2017 in the matter of Introduction of Composite Claim Forms (Aadhar and Non-Aadhar ) to replace existing Claim Forms No. 19, 10C & 31 and Forms No. 19 (UAN), 10C(UAN) & 31 (UAN). EPFO has since implemented Universal Account Number (UAN) for its subscribers. It is now possible for subscribers, who have seeded their UAN with Aadhar Number and Bank account details, to submit claim forms directly to EPFO without the attestation of employers. \

Ministry of Labour & Employment provides housing subsidy of Rs. 1,50,000/- per worker for construction of house.
Ministry of Labour & Employment has formulated Revised Integrated Housing Scheme (RIHS), 2016, which is applicable to the workers engaged in Beedi/Iron Ore Mines, Manganese Ore & Chrome Ore Mines (IOMC)/Limestone Ore Mines, Dolomite Ore Mines (LSDM) /Mica Mines and Cine Industries, registered with the Labour Welfare Organisation (LWO) in the country.
In the Revised Integrated Housing Scheme (RIHS), 2016 the housing subsidy of Rs. 1,50,000/- will be released in three installments in 25:60:15 ratio. First installment (25%) of the subsidy i.e. Rs. 37,500/- per tenement will be released as advance after proposal received from the Welfare Commissioner concerned, the second installment (60%) of the subsidy i.e. Rs. 90,000/- would be released on reaching the lintel level and the third installment (15%) i.e. Rs. 22,500/- per tenement would be released after receipt of 100% inspection conducted by the Engineers/Officers of the Labour Welfare Organisation that the construction of houses has been completed in all respect.
Ministry of Labour & Employment provides housing subsidy of Rs. 1,50,000/- per worker for construction of house.

ESIC Scheme Updates:Workers can soon choose insurance plans other than ESI
NEW DELHI: Over 2 crore formal sector workers will soon have an option to choose health insurance products available in the market in lieu of the mandatory scheme run by the Employees State Insurance Corp (ESIC).
At present, formal sector workers with monthly wages of up to Rs 21,000 per month are mandatorily covered under the health insurance scheme run by the ESIC.
"The Labour Ministry will soon send a bill to the Union Cabinet to amend the Employees' State Insurance Act 1948, to facilitate the beneficiaries of ESIC scheme to opt for health insurance products available in the market," a source said.
"The Ministry will push the bill for passage in the forthcoming Winter Session of Parliament beginning November 16," the source added.

Employers need to contribute Rs 200 monthly towards ESI scheme that will enable medical facilities for domestic workers, said Union Minister.
Labour Ministry will soon launch a social security scheme for domestic workers on pilot basis in Delhi and Hyderabad as part of Central government’s commitment to provide health insurance for all, Union Minister Bandaru Dattatreya said on Sunday.
“We will roll out a new scheme to bring domestic workers under the ESI fold. This scheme intends to provide ESI facilities to domestic workers. Employers need to contribute Rs 200 monthly towards this scheme that will enable medical facilities for domestic workers,” Dattatreya told reporters.
“We have decided to start the scheme soon as pilot project in Delhi and Hyderabad … we will involve NGOs also besides will talk to state governments to make the scheme better,” the Union Minister of State for Labour and Employment said, adding that Rs 200 per month contribution by employers will provide medical insurance for domestic workers and his/her family.
eiterating government’s commitment to bring all the unorganised sector workers under social security schemes, he said the process has begun to include around five crore construction workers to provide them with EPF and ESI facilities.
On Rajya Sabha recently passing the Maternity Benefit (Amendment) Bill 2016, that provides for 26 weeks maternity leave, Dattatreya said India will move to third position in terms of the number of weeks for maternity leave after Norway and Canada. “The Bill will benefit over 1.8 million women workers,” he mentioned.

ndian Railways employees are likely to be given 78-day wages as productivity-linked bonus (PLB) for the fiscal 2014-15, the same as in the last three years, despite the financial crunch.
The proposal to give 78-day bonus to railwaymen is likely to come up tomorrow at the Cabinet meeting, sources said.
If the Cabinet decides tomorrow for a 78-day bonus then about 12 lakh railway employees will get about Rs 8897 as bonus this month, they said.
There will be about 11 lakh railway employees who will get the benefit of PLB and it is estimated to cost more than Rs 800 crores to the public transporter.
In 2011-12, 2012-13 and 2013-14 also, 78-day wages were given as PLB to railway employees.
Productivity-linked bonus is paid to railway employees each year before the Dussehra festival.
However, General Secreatry of National Railway Federation of Indian Railwaymen M Raghavaiah said “We are demanding to increase the ceiling of Rs 3,500 per month as Labour Ministry has also advocated for the hike in bonus and we have written to Prime Minister for this.
“But since the election code of conduct is in force, the government has to have special permission from the Election Commission to raise the amount.”

Dear Shri Upadhyay,
Kindly refer to our discussion regarding the calculation ceiling for bonus. The Government is considering to revise calculation ceiling from the preset level of Rs.3,500 per month to Rs.7,000 per month or the minimum wages for the scheduled employment as fixed by the appropriate Government, whichever is higher. Minimum wages have not beed fixed as yet, however, the minimum wages will be fixed at a level which is respectable.
2. Under these circumstances, on an average the calculation ceiling for the purposes of bonus would be Rs.10,000 per month.
