GOVERNMENT EMPLOYEES NEED NOT FILE ASSET DETAILS UNDER LOKPAL FOR NOW

New Delhi: The Centre has extended indefinitely the deadline to file details of assets and liabilities by central government employees under a mandatory provision of Lokpal Act. A new format and fresh set of rules are being finalised by the government in this regard. The last date for filing such details was 31 December. 

“There is no requirement for filing of declarations of assets and liabilities by public servants now. The government is in the process of finalising a fresh set of rules. The said rules will be notified in due course to prescribe the form, manner and timelines for filing of declaration of assets and liabilities by the public servants under the revised provision of the said (Lokpal) Act. “All public servants will henceforth be required to file the declarations as may be prescribed by the fresh set of rules,” an order issued by Department of Personnel and Training (DoPT) said. 

There are about 50.68 lakh central government employees. As per rules, notified under the Lokpal Act, every public servant shall file declaration annually pertaining to his assets and liabilities as on 31 March every year or on or before 31 July of that year. 

For 2014, the last date for filing returns was 15 September. It was first extended till December, then till 30 April 2015 and third extension was up to 15 October. The date was again extended to 15 April 2016 and then 31 July for filing of the returns. The last date was further extended till 31 December after Parliament had passed a bill to amend the Lokpal and Lokayuktas Act, 2013. 

The declarations under the Lokpal law are in addition to similar ones filed by the employees under various services rules. The DoPT had last year also issued an order bringing NGOs receiving more than Rs one crore in government grants and donations above Rs10 lakh from abroad under the ambit of the Lokpal. The order had mandated filing of returns of the assets and liabilities by such organisations and their executives—director, manager, secretary or any other officer.

Attention is invited to Railway Board’s letter of even number dated 31.08.2015, whereby Department of Personnel and Training’s OM No. 11013/7/2014-Estt . (A- I I I ) dated 23.07.2015 was circulated reiterating the last date for filing the returns under the Public Servants (Furnishing of Information and Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) Amendment Rules ,2014 as 15.10.2015

2. in this regard, Department 0f Personnel and Training has issued O M No 407/7 2/2O14-AVD- IV(B)d ated 11.10.2015, extending  the last date for filing of returns under the aforesaid Rules from 15 10.2015 to 15.04.2016. A copy of the OM, dated 11.10.2015 aforesaid is enclosed

Lokpal Act – All Central Government Employees give two years asset details by October

NEW DELHI: All central goverment employees have to file the details Of their assets and
liabilities, as mandated under the Lokpal Act,for two years by October 15 this year."The annual returns of assets and liabilities under the Lokpal and lokayuktas Act,2013,for the years 2014 and 2015(which were to be filed by  April 30 2015 and July 31,2015,respectively)may be filed on or before october 15,"said a letter by the department of Personnel and Training (DoPT) to secretaries of all central goverment ministries.A Similar letter has been sent to chief secretaries of all states to ensure that all IAS,IPS,And IFS working under them file the property details by october 15.

As per rules, notified under the Lokpal Act every public servant shall file declaration,information and annual returns pertaining to his assets and liabilities as on March 31 every year or on  or before july 31 of that year.For 2014,the last date for filing returns was september 15,which was later extended to December -end,then till April 30, and now up to this October 15,Employess also have to file the details of their assets for 2015 by the extended date.

The declarations under the Lokpal Act are in addition to similar ones filed by The emloyees under various service rules.

All Group A,B and C employees are supposed to file a deeclaration under the new rules.Employees need to give details like cash in hand, bank deposits, investment in bonds, debenturesl shares and units in companies or mutual funds, inssurance policies, provident fund, personal loans and advance given to any person or entity, among others.The DoPT has already clarified that the failure to declare assets by government employees while filing property returns under the Lokpal rules will be presumed to have been acquired by corrupt means.
